摘　　要：随着世界进入知识经济时代,知识产权合同在保护知识产权,进行科学技术、经济、文化交流与合作中发挥着越来越重要的作用,对知识产权合同违约金约定的标准、数额问题,由于立法缺位,致使各地法院执法不一,本文试图对此问题进行探讨,以期完善我国的知识产权法律制度。With the coming of the knowledge economy＇s age, the contracts about intellectual properties are playing a more and more important role in the fields such as the protection of intellectual properties, the operation of science and tectnology, the communication and cooperation of businesses and cultures. Because of the different standards of the breach fee and its amount in law makings and in the applications in local courts, the artical discusses the problem to enhance the legal system of our nation＇s intellectual property.
