摘　　要：依法执政是指执政党依照宪法和法律确定的国家政权运作方式来掌握国家政权的执政方式,实现依法执政的前提是依法授权。本文从中国共产党的授权机关的权力地位出发,进一步探讨目前党依法执政的突破口必须使授权机关权力显性化,才能真正完成依法执政与依法治国的有效统一。Legally being in power is refers to the incumbent party the state power operation way which determined according to the constitution and the law to grasp the state power the ruling way, the realization legally is in power the premise is legally is authorized. This article embarks from Communist Party of China＇s authorized institution＇s authority status, further discusses the breach which the present party legally is in power to have to cause the authorized institution authority dominance, can truly complete legally is in power with the effective unification which legally rules a nation.
