摘　　要：在我国和越南的法律体系中,经济法都是作为一个独立的法律部门而存在的(虽然中国的理论界对此颇有争议),然而,两国都没有一个关于经济法的总纲性立法,经济法在中越法律体系中的独立地位都是基于与经济关系相关的众多部门法而建立起来的。经济法基础理论中存在的种种至今无法完全解决的争议,使经济法领域的研究陷入了困境,但是这并不阻碍我们对于具体制度的研究,尤其在中国和越南这样极具可比性的国家之间,对于两国具体经济法制度的比较研究更显得尤为重要。虽然越南的经济法研究工作以及立法和司法工作的起步晚于中国,但是经过十多年的发展,越南经济法的各项制度已经趋于完备,而且在某些方面还可以为我国经济法制度的完善提供借鉴。In China and Vietnam＇ s legal system, Economic Law is a separate legal department, however, the two nations don＇ t have a master law. The independent status of the economic law which in the China - vietnam legal system was related to the department of law what based on the economic rlationship. Economic theory based on the variety has not fully resolve disputes and to enable research in the area of economic law caught in a predicament, But this does not impede our specific system for the research, particularly in China and Vietnam what have highly comparability . For two specific economic law system , the study appears to be particularly important. Although Vietnam Economic research, as well as legislative and judicial work, got a late start in China, but after 10 years of development, Vietnam Economic Law of the system has become be completed and in certain areas, it can also be a reference for China Economic System.
