论三峡库区生态补偿法律制度的建构

摘　　要：三峡库区生态补偿法律制度建构是三峡工程长治久安的需要,是保护长江流域和整个国家生态环境的需要,是实现社会公平、构建和谐社会的必然要求,同时可以为国家生态补偿立法积累经验。三峡库区生态补偿法律制度的原则包括保护生态安全原则、公平原则、政府主导和市场推进相结合的原则。在库区生态补偿法律制度层面上,应当包括国家宏观调控法律制度以及市场补偿法律制度两个方面。The legal system construction of Ecology compensates in The three gorges reservoir area is of urgent need of a lasting good order concerning three gorge＇s project; is of the ecological environmental need of protecting Yangtse River as well as the whole country; and it＇s the necessity of establishing the social equity in addition to a harmonious society. Additionally, it will provide accumulated experience for the whole country＇s litigation of ecology compensates. The legal principles of ecology compensates in The three gorges reservoir area consist of Protecting ecological security principle, he fairness doctrine, and the principle of government leading factor with marketplace propulsion. Regarding the legal system of ecology compensates in this area, we should take both the country＇s macro-control legal system and the marketplace compensates into consideration.
