摘　　要：在美国保险法中,惩罚性赔偿责任究竟是否具有可保性是一个备受争议的问题。解决该问题的方法是根据惩罚性赔偿责任的具体形态并结合具体案件来判断,进而决定能否将惩罚性赔偿责任纳入保险合同的承保范围。In American insurance law, the insurability of punitive damages is a controversial problem. The way to solve this problem is to decide the case according to the material form of punitive damages, and further to decide whether the coverage of insurance includes punitive damages.
