节约型社会视角下的物权客体

摘　　要：传统物权客体理论在指导思想、物的特征表现、价值属性和使用方式等方面与节约型社会理念存在诸多矛盾。节约型社会视角下的物权客体制度需要以经济学的"效用主义"为指导,通过非市场评价法将物的生态价值货币化,从而建立一个以一般法和特别法相结合的法律规定为主体、以法律解释为补充的法律体系。The orthodox theory of the object of property right conflicts with the Conservation - oriented Society, relating to the guidelines, characteristic of object, value attribute and the way of use. However, this problem could be resolved by utilitarianism in economics which could gain the monetization of the ecological value through un - market analysis, so the idea of Self - Regard in the property right law would be combined with the protection of the environment and resource. The object of property right from the conservation - oriented society viewpoint requires a legal system which should not only mainly base on the provisions, which include common ones and special ones, but also have some legal explanation as the supplement.
