摘　　要：外商投资特许权项目(BOT)是近年来被世界各国普遍采用的国际新型投资、融资方式。而BOT投资方式的实施在很大程度上取决于是否能够获得政府保证。这是因为,尽管外国投资者以BOT方式投资于东道国的基础设施建设既开拓了市场又可以赚取利润,但它与一般投资方式相比存在更大的商业风险和政治风险。正是由于BOT投资方式存在着巨大的风险,才使得政府保证有其存在的必要性。BOT is a kind of investing and financing tool that is widely adopted all around the world. And normally a potential foreign investor will not invest in BOT form before he acquires the government guarantee. The reason is that although the foreign investor can both increase its marketing share and earn profits through investing on the infrastructure construction in the BOT form, he usually have to bear higher commercial and political risk than in the common investment form. And the high risk in the BOT form makes the government guarantee necessary.
