摘　　要：土地征收救济制度的基础是征收权之立法规制,尤以征收程序的设置最为关键,中国的征收程序条款设置存在缺陷应予完善;土地征收救济模式有法院主导型和议会主导型之分,中国的征收救济模式缺失,现实国情决定中国应选择议会主导型救济模式;土地征收救济方式表现为不同的具体诉讼形式,中国至少应赋予被征收人享有就征收补偿纠纷而提起民事诉讼的救济方式。Relief mechanism of land expropriation is based on the legislative stipulation of expropriation power,of which establishment of expropriation procedure plays a prominent role particularly.Flaws exist in the establishment of expropriation procedure articles in China and shall be cleared.The relief pattern of land expropriation can be concluded as the court leading pattern and the parliament leading pattern,while relief pattern is absent in China at present.Practical national conditions determine our choice of the parliament leading pattern.Relief approaches of land expropriation highlight various specific lawsuits,and China shall at least entitle the expropriated to launching a civil lawsuit concerning expropriation compensation disputes.
