我国海洋运输货物保险“一切险”条款有待完善

摘　　要：《海洋运输货物保险条款》规定,"一切险除包括平安险和水渍险的各项责任外,还负责被保险货物在运输途中由于外来原因所致的全部或部分损失",而对于"外来原因"条文中却没有作出明确界定,对此我国保险界历来颇有争论。本文从PICC的法律制定依据、相关的法律规定以及国际保险行业惯例三个角度分析了此处外来风险的界定问题。The All Risks Clauses contained in the Ocean Marine Cargo Clauses of People＇ s Insurance Company （referred to below as the PICC） are ＂Aside from the risks covered under the F. P.A. and W.A. conditions as above, this insurance also covers all risks of loss of or damage to the insured goods whether partial or total, arising from external causes in the course of transit＂. However, there isn＇ t a clear definition of the term external causes, which always causes some disputes in China. This paper analyses the boundary of the term external causes from the aspects of bases of the clauses, related regulations and international conventions of insurance industry.
