摘　　要：电子商务离不开计算机软件和电子商务商业方法的支撑。计算机软件和电子商务商业方法是专利法保护的客体,具备专利保护的法定要件,可以获得专利保护。数字图书馆在电子商务过程中,应采取有效措施,保护自己的合法权利,避免侵犯他人计算机软件和电子商务商业方法的专利权。The E-commerce must be supported by the computer software and the business methods of E-commerce. The computer software and the business methods as objects protected by patent law, meet the lawful requirements of the patent protection, and can gain the patent protection. In the E-commerce process, the digital library should take the valid measures to protect its own legal right, and avoid infringing upon the patent rights of the other computer software and the business methods of E-commerce.
