摘　　要：城市房屋拆迁中的公益性拆迁是国家为了维护和实现公共利益而依法对城市房屋所有人或使用人的房屋进行拆迁的征收行为。公益性拆迁涉及被拆迁人的基本财产权利,原则应由法律加以设定。其实施不能照搬现行《城市房屋拆迁管理条例》设定的程序,应遵循自身的特别规则。Public beneficial removal is the behavior that the country removes the urban house of owners or users according to a series of legal norm, in order to safeguard and realize the public interests. It should first define the concept, characteristic and nature of public beneficial removal, so as to study the settlement and implementation of public beneficial removal. Because public beneficial removal involves people＇ s fundamental right whose houses are removed, it should be established by the law. Meanwhile, in the course of implementation of public beneficial removal, a certain procedure should be fallowed.
