制度供给滞后背景下的体制缺陷——以转型期难以实现权利的农民工为例

摘　　要：透视农民工在城里务工所遇到的工资、人身伤害、社会权益、社会阻隔等多方面的工作和生存环境问题,揭示出社会转型期"二元制"经济结构的严重滞后性所导致政策的普遍价值的缺损;反映了在经济体制转轨之后,随着权力的转移,部分权力运用的失控,市场与法制难以兼容,市场对法律条文的挑衅;显示出农民工在被边缘化的状态下权益及利益难以保障。In the process of social transition in China, defects of market economy and some other institutional drawbacks result in some impediments to the protection of the rights of migrant workers from rural parts of the country. One of the prominent obstacles is a critical lag of double economic system between city and country, which causes a series of problems covering the absence of policy＇ s common value, incompatibility between the market and the law, etc. In a word, it is very hard to protect the interests and rights of the migrant workers who constitute a marginalized and disadvantaged group in urban areas.
