摘　　要：分析了科学数据共享与知识产权保护的对立统一关系,探讨了当前我国科学数据共享与知识产权保护存在的共享意识薄弱、产权界定不清、利益分配不当和宏观引导不够等问题,并提出了建立政府引导机制、健全共享法规体系、明晰产权界定和规范产权交易机制等建议和对策。Unity and opposites between the intellectual property protection and scientific data sharing was analyzed. Were investigated some problems of the intellectual property protection and scientific data sharing, for example, the weak awareness of data sharing, the vague definition of property rights, the inappropriate distribution of benefits and the lack of macro-guidance for the protection and the data sharing and so on. Some suggestions and measures are also proposed, including to establish the governmental guidance system, to complete the legal systems for data sharing, to definite the property right and the regulation for the property transaction clearly.
