未成年犯社区矫正之现实探讨及其制度设计

摘　　要：当前,我国的社区矫正制度处于工作试点与理论研讨同步摸索与推进的态势,但种种举措均局限在修补的层面,喧嚣而无序,尤其对未成年犯而言,我国的未成年犯社区矫正还处在摸索阶段,在矫正主体、矫正项目、矫正方法上还存在重大缺陷。应当融入契约理念,"以人为本",使未成年犯社区矫正之内涵与功能更为丰富。同时,鉴于未成年犯的身心特点及权益保障,应当对"教育为主、惩罚为辅"下的制度进行改进和创新,例如建立监护人或"合格成年人"参与制度、志愿者聘请制度、异地矫正制度和权利救济制度等。The system of community rectification in China is now underway, but all the measures taken are restricted to trifles. Obvious defects exist in rectification subject, item and approaches, especially when referring to community rectification for juvenile delinquency. The notion of covenant should be introduced into the system of community rectification, which will enrich the content of rectification and improve its functions. Meanwhile, according to the characteristics of juvenile delinquents and for ensuring their rights and interests, corresponding systems should be established or improved.
