国际公约对放射性废物越境转移的一般规定和我国的防治对策

摘　　要：随着废金属国际贸易的发展,放射性废物随之越境转移的问题已日益成为一个国际问题。对此国际原子能机构1997年通过了《乏燃料管理安全和放射性废物管理安全联合公约》,旨在建立一个防止放射性废物非法越境转移的国际法框架。本文介绍了该公约对控制放射性废物越境转移的一般性规定,分析了其存在的主要问题,提出我国防治放射性废物越境转移应加强国内立法、完善技术标准、扩大国际合作等。Along with the development of international trade of scrap metal, it is becoming an international issue that radioactive wastes as concomitants of scrap metal transit transfer. In order to prevent illegal transit transfer of radioactive wastes, the IAEA enacted the Joint Convention on the Safety of Spent Fuel Management and on the Safety of Radioactive Waste Management, as well as to establish a legal frame at international level. This article introduces some general regulations for controlling transit transfer of radioactive wastes in the Joint Conventions, and analyzes the disadvantages. The article also put forward some suggestions （e.g. to strengthen civil legislations, to perfect technical standards and to enlarge international cooperation, etc.） for protesting China from being polluted by radioactive wastes from overseas.
