摘　　要：限定继承制度的立法宗旨在于公平地保护继承人和遗产债权人的合法权益。我国继承法借鉴前苏联的立法经验,规定了限定继承制度,但在操作过程中存在很大的缺陷。应结合我国社会生活实际,确立遗产管理人,建立财产分离和遗产清册制度,增加催告遗产债权人申报债权的程序,对遗产分配的时间加以限制,并规定相应的诉讼程序,以有效发挥限定继承制度的作用。The purpose of limited succession and heritage successors. Chinese inheritance law system is to protect the legitimate rights, interests of creditors has adopted legislative experiences from the former Soviet Union. But there are many flaws in practice. We should establish legal systems relating to administrator, separation of property, heritage inventory, disclaim period and judicial proceeding in accordance with Chinese social experiences so as to make the limited succession system more effectively.
