摘　　要：中国向现代国家迈进,必须要倚重一支高素质的公务员队伍。对公务员内涵的界定,最核心最关键的因素就是其手中“握有”公权力,即“依法履行公职”。国外对于公务员范围的划分虽然方法不同,但适用公务员法的人员范围大致相同,即行政系统中非选举产生和非政治任命的公职人员,这部分人是公务员的主要范畴,也是公务员法的适用范围。China moves forward toward modern nation, must entrust a civil servant troops of high character. It should be explained that the civil servant＇s official business behavior, what to exercise is a social civic rights, function in public space, so the people＇s con cern to the civil servant, is the concern to the national power＇ s circulation actually, to the concern of the administration cost, to the con cern of public management and the social service levels that themselves should possess. According to this, the article selected the civil servant scope as the insertion, passing by the relatively comb of the Chinese and Foreign lawmaking norm and the system ful fillment, got the understanding of the civil servant scope under the existing power frame of our country.
