村民自治中的权力构架及司法救济

摘　　要：村民自治运行过程中,由于利益角度的差别,自治体内村民个体的权利、自治机构的权力及国家权力之间,必然会发生冲突。因此,保障村民自治正当有序运转,必须尽快完善村民自治中的权利(力)构架:党委与村委——监督与被监督;乡(镇)政府与村委会——平等法律主体,主要通过行政合同、行政指导的手段,以柔性方式促进后者自愿参与,共同完成公共行政目标;村委会与村民——既存在委托与被委托人的关系,又存在管理与被管理的关系。对其之间发生的冲突,应根据不同的法律关系,适用相应的司法救济。In the operation of villagers＂ autonomy, because of different interests, conflicts of the rights from individual villagers inevitably occur , and powers between the autonomous and state bodies also contradict. Therefore, for the purpose of safeguarding the regular and orderly operation of villagers autonomy, framework for powers and rights should be improved as soon as possible,in which the local Party committee supervises the villagers committee, meanwhile the township government and villagers committee are of equal legal subjects, which can accomplish public administrative purposes via administrative contracts and instructional acts or through the volunteer participation of the villagers committee in a flexible way. Moreover, the relationship between villagers and villagers committee is not only of a mandate relationship, but also of an administration relationship. Judicial remedies to the conflicts arising from them should be adopted in accordance with different legal relationships.
