摘 要:房地产抵押贷款证券化是国外一种比较成熟的资产证券化的融资手段,近年来,随着我国居民个人贷款购房的迅速增加,银行住房贷款业务迅猛发展,在我国开展房地产抵押贷款证券化的呼声也日益高涨。针对我国证券化方面的法律非常不健全的状况,探讨了房地产抵押贷款存在的法律风险。Residential mortgage--backed securitization is quite a mature financing means in foreign countries. In recent years, along with the rapid increase in housing loans for individuals, the banks' business concerned also develops greatly. Thus commercial banks in which the source of funds is mainly from short-term deposit easily got into the trouble of funds fluidity due to the long-term loan. Therefore, it is critical in China to develop residential mortgage--backed securitization. This paper probes into the legal risks existing in the residential mortgage based on that the law of the securitization is far from the Deflection.
