摘　　要：医疗机构接受医药企业赞助行为的定性问题是当前治理医药购销领域商业贿略过程中的热点问题之一。阐述了赞助与捐赠的含义,对理论界和实务界的不同观点进行了比较分析,提出了作者自己关于该问题的观点,认为对医疗机构接受医药企业赞助的行为,应当具体问题具体分析,既不应简单地认定其必然合法,也不应一律视其为非法而一概加以禁止,必须根据《公益事业捐赠法》和《反不正当竞争法》等法律法规的规定对其进行定性,并通过健全和完善相关法律法规来加以规范或管制。The cognizance problem of medical organiZations accepting sponsorship from medicine business enterprises isone of the hot topics in controling business bribery in medical industry at present：In this article, firstly, the author explains the meaning of sponsorship and donation.Then he analyses the different viewpoint in the theoretical field and the practical field.Finally, he puts forward his own point of view concerning that problem;The author thinks that we should analyse different problems in different ways to medical organizations accepting sponsorship from medicine business enterprises.We shouldn＇t simply affirm it legal, either we shouldn＇t treat it as illegal.We must act according to Welfare Donations Law of the People＇s Republic of China and Law of the People＇s Republic of China for Countering Unfair Competition to cognize that problem.And we should adjust or control it with perfect laws.
