摘　　要：刑事诉讼中存在着国家权力与公民权利的冲突,这种冲突在刑事强制措施中表现得尤为突出。公民权利既需要国家权力的保护,又难免遭受不正当权力的侵害,因此需要实现国家权力与公民权利的平衡。在刑事强制措施中国家权力与公民权利的冲突多体现在违法适用刑事强制措施上。文章从刑事强制措施中国家权力与公民权利冲突的表现形式出发,试图寻找解决冲突的方法,以保障公民的合法权利。In criminal action, there exists the conflicts between state power and the rights of the citizens. Such conflicts in the criminal compulsory measures performance was particularly conspicuous. Civil rights not only needs the protection of state power, but inevitably suffers undue power abuse. Hence the need to achieve state power and the rights of the citizens balances. In criminal compulsory measures, conflicts between state power and the rights of the citizens reflected in the criminal law applicable mandatory measures. From criminal compulsory measures＇ manifestations of conflicts between state power and the rights of the citizens, we try to find ways to resolve the conflicts, so as to safeguard the legitimate rights of the citizens.
