优先权的顺位及与其他担保物权的竞合效力

摘　　要：确定优先权的顺位,主要应遵循公平原则、尊重和保护基本人权原则以及“最后保存行为,优先受偿”原则。应当依据权利本身的性质以及法律公平、正义、衡平、保护基本人权等价值理念,解决优先权的顺位安排及与其他担保物权的竞合效力问题。The sequence of priority is confirming the sequence to solving the right conflicts when two or more priorities are in one property. Solving the right conflicts problem, we should determine the sequence of priority and the superposition of other property rights of guarantee according to the nature of the right and the value of law concluding equity, justice, beneficial balance and protecting basic human rights.
