摘　　要：国家及其财产的管辖豁免是一个古老而又常新的问题,同时又是一个重大的理论和实践问题。2004年12月16日第59届联大通过了《联合国国家及其财产的管辖豁免公约》,我国政府也于2005年9月签署了该公约,这就使得国家及其财产的管辖豁免问题再次引起人们的关注。在国家及其财产的管辖豁免中,该国的国有企业同另一国自然人或法人之间从事的商业交易行为是一个比较重要的问题,本文将结合《公约》的相关规定和各国的实践对该问题进行详细阐述。Jurisdictional Immunity of State and its Property is both an old and new problem facing the theory and practice.On December 16,2004,the 59th General Assembly adopted the United Nations Convention on Jurisdictional Immunities of States and Their Property,then China signed it in September,2005.Combining provisions of the Convention with the practices in other countries,this article discusses in detail the issue of commercial actions of State's enterprises with natural or legal persons in another State.
