摘 要:我国地方政府开始对行政立法进行各种形式的后评估,但于后评估对象尚未达成共识。本文将后评估之适用范围分为基本对象和特殊对象,前者为地方政府行政规章,后者包括地方重大财政预算、其他行政规范性文件、临时性行政许可、地方行政规划;前者为基础,亦为当前实际做法,后者则具有前瞻性,为后评估所"应然"之对象。The Chinese local governments have launched various kinds of evaluation of the local administrative legislation. However, the targets have not been agreed upon in the end. The present paper defines the range of evaluation in two parts: basic objects and special objects. "The former refers to the local government administrative regulations; while the latter includes major local budgets, other regulatory documents, the temporary administrative permission, and the local administrative planning. The former is regarded as a base, or the real practice at the moment; while the latter is embodied with a forward -looking quality. It "should be" the targets of the evaluation.
