和谐社会背景下的结社自由问题——以农民的结社权为例

摘　　要：结社自由是宪法规定的一项基本政治权利,作为中华人民共和国公民的农民,理应享有充分的结社自由。但事实上,在传统的"城乡二元结构"背景下,农民的结社自由难以得到充分的保障,其主要原因在于对农民结社存在观念障碍,将农会视为一种对抗性组织。在构建和谐社会的新的历史条件下,消除这种误解,有利于保障农民的政治权利,推动国家的民主与法治,维护社会的和谐与稳定。The freedom of association is a basic political right. The peasants, as citizens of the People＇ s Republic of China, should enjoy the full freedom of association. But actually, under the background of ＂urban - rural dual structure＂ in china, it is difficulty to obtain full safeguard for the peasants. Its main reason is the peasant association is regarded as one kind of antagonism organization. Under the new historical condition of construct the harmonious society, eliminates this kind of misunderstanding, is advantageous to safeguard peasant＇ s political rights, to impel the democracy and rule - by - law in our nation, to maintain the harmony and the stability of society.
