摘　　要：某一行为或规则正当与否,有赖该行为或规则与法律正义的统一性关系证成。因违约而致的非财产性损害可能而且应该在合同领域实现救济,因为这种救济:一不违背违约损害赔偿的基本原则,二不违背合同正义价值的当然追求。Whether one action or regulation is just or not should be relied on the demonstration of the legal unity between one action or regulation and the legal justice. In fact, accepting the compensation for spiritual damages under the breach of contract is proper, for which is in according with the basic principle of contractual relief and connects with the value and contractual justice.
