摘　　要：《国际合同使用电子通信公约》于2005年11月在联合国大会上决议通过,它是有关电子商务的第一个专门性公约,也是近年来国际商事立法最重要的成果。公约的目的是采用统一规则消除对国际合同使用电子通信的障碍,也确立了媒介和技术选择自由、不偏重任何技术及功能等同原则。在解读公约的主要条款的基础上对公约的先进性、科学性及局限性做了立法评价。Convention on the Use of Electronic Communications in International Contracts was adopted by the United Nations General Assembly on 23 November 2005. The Convention is the first Convention on E-commerce and the most important development in the field of international commerce law in recent years. This paper firstly introduces the legislation background and aims of the convention, then analyses the main provisions of the convention. Furthermore, this paper gives some assessment on the convention.
