摘　　要：单位自身和单位成员在单位犯罪中各自都不具备完全独立的主体人格,它们双方综合作用形成单位独立的整体人格,由于它们各自在单位意志形成过程中所起的重要作用和一定的相对独立性,所以单位犯罪时,双方都应当承担刑事责任。Unit and its members do not have independent subjective personality respectively in unit crime, They act with each other to form independent whole personality of unit. Each of them plays an important role and has relative independence to some extent in the process of the formation of units＇will, therefore, both of them should bear criminal responsibility when units commit crime.
