WTO《保障措施协议》中非歧视原则的归位

摘　　要：在贸易自由化的进程中,GATT的多边保障机制起着一定的调控功能,但这种机制在运转中却屡屡失灵,其原因之一便是对非歧视原则的背离。在越来越重视"规则"的多边贸易体制下,这种规则失灵的局面迫切需要加以调整,应加强非歧视原则的约束力。本文探讨了WTO《保障措施协议》中非歧视原则回归的表现,并对其做出粗略的评价。During the course of trade liberalization,the CATT multilateral safeguard mechanism plays the cer tain regulative function,but this kind of mechanism fail to operate normally,One reason reason is that it departs from the principle of non-dicrimination ,Under the multilateral trade system which more and more values rules,it is urgent to adjust the situation of rule malfunctions in order to revolve the rule.That is to say that it i must strengthen the binding force of the principle of non-discrimination in the safeguard mechanism.This article discusses the return of the principle of non-diserimination in WTO Safeguards Agreement and roughly analyzes it.
