摘　　要：我国现行法律对婚前协议和婚后协议的内容、生效的要件等基本问题均未规定,导致对此类案件司法判决的不统一。婚姻协议具有不同于一般合同的特殊性,应对其可约定的内容及生效要件作特别的规定。Nowadays, the content of pre-marriage contract and past-marriage contract and the conditions of its coming into effect is still not regulated by the current laws, leading to the divergence of judicial decision of this kind of cases. Different from other common contract, marriage contract should be specially regulated from the aspects of the content to be appointed and the condition of coming into force.
