助力车道路交通侵权归责原则重构

摘　　要：助力车作为一种新型交通工具,其性质介于机动车和非机动车之间,因此,助力车的侵权责任分配机制也具有自身的特点。过错责任无法约束助力车的危险性,而单纯的无过错责任相对于助力车而言又过于严格,"优者危险比例责任",在助力车侵权责任的分担适用中能够兼顾公平价值和效率价值。对助力车施以相对严格的责任既是出于对行人、自行车等弱势群体的公平的需要,也是恶化助力车侵权环境、控制助力车消费无序增长的法律手段。让助力车行为人承担相对严格的责任会给其带来沉重的负担,为此我们需要引入责任保险和补偿基金制度等方式将助力车交通事故带来的危险和损失社会化。As a new generation of vehicles, moped scooters are on the cross-border of motor vehicles and non-motor motor vehicles. Therefore, the imputation principles for moped scooters are of their distinctive features. Tort liability cannot relieve the dangers faced by moped scooters, while liability without negligence is too rigid for them. One proposal is that ＂ proportional responsibility for the accidents on the advantaged＂ can guarantee the rights of members of the disadvantaged group like pedestrians and bicycle riders. It can also give due consideration to fairness and efficiency.
