摘　　要：数据库是一种以信息为内容的高投入低边际成本的信息产品,单纯地运用我国现有的法律保护制度无法突出其专业性和特殊性。因此,通过对数据库进行专门的立法保护,平衡开发方和使用方之间的权利义务关系以及兼顾社会公益,将有利于推动数据库产业的健康发展及其市场的规范运作。Database is a kind of information product but present legal protection system in China cannot give prominence with high investment and low marginal cost. And the to its speciality and particularity. So making a specialized law to protect the database, balancing the right between producers and. users, and concerning both sides and welfare, wiLL push forward the database industry healthy development and its market standardization.
