摘 要:不能正确说明法律与政策的关系,法律与政策混同,这种现象在法学领域是"泛法律化",在政治学领域是"泛政策化",两者具有相同的问题属性。产生泛法律化的原因,一方面是因为错误的政策观念,对我国执政党政策和国家法律之间的现实关系不能给予正确的解释,并且习惯于把政策策略化;一方面是不能从功能价值、工具属性和主体分析上将法律与政策区别开来,导致法律的矮化。法律规范在一定意义上构成政策空间的制度约束,政策空间即政策主体进行政策选择的自由度,在严格的法理逻辑上,行政机关为履行其行政职能而制定的规范性文件应该属于政策的范畴。"行政法治"是指合法的行政,而不能解释成用行政法去行政。It is called "extensive law "in law area if we cannot explain the relationship between policy and law correctly. If we confuse them in political area, it is called extensive policy. The two have the same nature. The reason on one side is the false concept of policy, for we cannot give a correct explanation of the realistic relationship between the ruling party's policies and laws in our country and we are used to regard policies as strategies. On the other side we cannot differentiate laws from policies in the function value, nature and subject analysis, which results in the weakness of law. Laws is the institutional control of policy space, and policy space is the freedom that policy subject chooses policies. In the strict legal logic, the regulative documents made by the administrative departments for accomplishing their functions belong to policy category. Rule of law means that the administrative departments accomplish their functions legally instead of working by Administrative Law.
