摘　　要：我国刑法规定了各种妨害传染病防治行为的犯罪构成及其法定刑。国家之所以刑惩妨害传染病防治的行为,其法哲学依据在于:妨害传染病防治行为所具有的严重的社会危害性和行为人所表现出来的严重的人身危险性,是二者的有机统一。Infectious diseases, for example, non-typical pneumonia, etc, badly endangers human safety. The basis of the criminal responsibility punishing acts of impairing prevention and treatment of infectious diseases, rest with that the acts badly endanger society and the criminal has obvious personal fatalness.
