摘 要:企业广告宣传画册在法律上系汇编作品,对其权利归属的判断,除了考虑委托创作协议的约定之外,还需尊重其它民事主体的合法在先权利。摄影作品底片持有人与底片上的权利声明不一致时,应当根据权利声明的内容来判定著作权的归属。Because the advertising albums of paintings of enterprises belong to collection works in law, how to judge their ownership not only needs to consider the agreement of trust-creation-contract but also needs to respect the legal prior right of other civil subjects.
