摘 要:我国法律逻辑学界对法律推理的定义和划分存在诸多问题,其根源是研究进路不统一。从逻辑学进路重新定义法律推理,彰显其逻辑学特征,揭示其逻辑学本质,体现"宽泛"的法律推理观,便于实现法律逻辑学界对法律推理定义的统一。从逻辑学的进路重新划分法律推理,恪守逻辑学的划分原则,凸显辩证逻辑推理形式在法律推理中的地位和作用,利于实现法律逻辑学界对法律推理划分的统一。Currently, the understanding of legal reasoning definition is very inconsistent in our country law logic educational circles. Its manifestation lies in the disunity of choosing the concept of genus, the definition of specific difference is very narrow, the confusion of relation between reasoning and argument. Its root lies in the disunity of research admission passage. The new definition about law reasoning showed by us argues that all of these belong to the logic the admission passage. Show its logic characteristic, reveal its logic essence, and incarnate the wide legal reasoning, to realize the unification of legal reasoning definition in legal logic educational world. The divide of legal reasoning is much inconsistent in our law logic educational circles, too. Its manifestation lies in diversity of line of division, basis of division and sub term of division, and so on; its root lles in the disunity of research road, too. We give a new division that all of these belong to the logic the admission passage, conform to the logic division principle and to protrude the place and affection of dialectical logic and form of inference in the legal reasoning, and realize the unification of divide about legal reasoning in legal logic educational circles.
