摘　　要：药品知识产权保护的特殊形式以专利期延长和独占为主,它们具有各自不同的特点和法律效力。其与专利等传统的保护形式一起构成了药品知识产权保护体系。现对我国及其他国家药品知识产权保护的特殊形式及相关规定进行介绍,并通过与专利保护相比较对其特点进行分析,为药品科研、生产、经营、使用单位和管理部门提供参考。Patent term extension and exclusivity are the two central sui generis rights of pharmaceutical intellectual property. They have different characteristics and force adeffect. Sui generis rights of pharmaceutical intellectual property and other traitional rights together constitute the pharmaceutical intellectual property system. This paper was performed to give a particular introduction of the sui generis rights of pharmaceutical intellectual property in China and other countries, analyze their characteristics by comparing with patent protection, and supply references to the pharmaceutical scientific research centers, manufacture corporations,management sections and administration departements.
