摘　　要：国家与时俱进修改《公司法》,取消了企业提取法定公益金的规定;法定公益金失去存在的理论基础和现实意义;取消法定公益金有利于培育投资环境、有利于更好的维护员工利益、有利于和谐社会的构建。In accordance with the new era, our country has revised The Company Law, which has cancelled the enterprise -extracting legal public fund. Thus the legal public fund has lost its foundation for existence and its practical significance. The cancelling of this legal fund is beneficial to fostering the investment environment, better safegarding the staff menbers＇ interests, and constructing the harmonious society and so forth. A gambling interpretation of this cancelling will be made in this essay.
