摘 要:在我国《物权法》的立法过程中,有关善意取得的构成是否以转让合同的有效为要件是争论的焦点之一。由于善意取得的构成以无权处分为前提,因此,无权处分行为的效力一般会影响该转让合同的效力;除无权处分之外,合同的其它效力瑕疵对善意取得也将产生影响。在不同的物权变动模式下,转让合同效力对善意取得的影响不同。在我国的物权变动模式下,善意取得不应当以转让合同有效为要件,但是转让合同应当在善意取得构成后被视为有效。In the legislative process of China' s Property Law, whether a valid contract for transaction is the requirement for the constitution of the acquisition in good faith is one of the debated issues. As the unentitled disposition is prerequisite for the acquisition in good faith, the effectiveness of the unentitled disposition generally will affect the effectiveness of the contract for transaction. Besides the unentitled disposition, other flaws of the effectiveness of the contract will also have an effect on the acquisition in good faith. Under the different models of the property changes ,.the effectiveness of the contract for transaction has the different effect on the acquisition in good faith. Under the model of China's property changes, the validity of the contract for transaction shall not be the prerequisite for the constitution of the acquisition in good faith. However, the contract for transaction shall be presumed to be valid after the constitution of the acquisition in good faith.
