省级农业科研单位知识产权归属探讨

摘　　要：综合运用管理学和法学知识,采纳规范分析和理论研究的方式,参考国外知识产权归属变化的一般规律,针对省级农业科研单位知识产权保护中存在研究单位和管理部门之间、单位与个人之间存在知识产权归属不明、利益不清的现状进行了分析,得出以下结论:现阶段在省级农业科研单位中加强知识产权保护工作的前提是明确知识产权归属,而解决知识产权归属的主要办法是使知识产权的所有权与使用权适当分离,从而一方面可以更好地调动科研人员自主知识产权创新的积极性,另一方面可以充分发挥知识产权在社会经济发展中的作用。The current situation of undefined attribution and benefits in intellectual property between the institute and management department or institute and its staffs in intellectual property protection of the provincial agricultural research institutes was analyzed by comprehensively using the management theory and law knowledge, adopting the normative analysis and theoretical research pattern and referring to the general regulation of attribution change in intellectual property abroad. The results indicate that the main method of strengthening intellectual property protection is to define the attribution of intellectual by properly separating the ownership and use right from intellectual property to mobilize the enthusiasm of scientific research personnel in self-governing intellectual property innovation and to give full play to the effect of intellectual property in social economic development.
