摘　　要：电动自行车的"禁"与"行"在我国不同地区正经历着不同的命运,本文以权力与权利为切点,运用社会功利主义法则,从法理上探讨了电动自行车应禁还是应行。The electrically operated bicycle ＂endures＂ and ＂the line＂ is experiencing the different destiny in the our country different area, this article take the authority and the right as the tangential point, the utilization society utilitarianism principle, discussed the electrically operated bicycle from the legal principle theory of law to be supposed to endure or 应行.
