摘　　要：在"制度效益"概念框架下构建起我国专利法运行效益综合评价指标体系,根据国家统计局发布的98年—2005年统计数据建立模糊数学模型,运用模糊数学评判法和层次分析法对专利法运行的综合效益进行了实证研究并对结果进行了评估和预测。研究结果表明,在这一时期我国专利法的综合效益虽然总体上呈增长趋势,但依据制度效率递减规律,急需对专利法进行第三次修订。The paper establishes the evaluation index system on the overall performance of china＇s Patent Law, on the basis of which the empirical study is maken on its social and economical effect by way of fuzzy model. The conclusion shows the performancs of the Patent Law has being grown in 1998 - 2005. By using of the theory of institution change and law of diminishing institution efficiency, empirical conclusion is esplained, combined with practice.
