摘　　要：本文从政府依法行政框架下高校法律地位的界定、高校自主办学的基本内涵、高校自主办学背景下政府依法行政的本质要求等三个维度对高校自主办学与政府依法行政进行了理论分析,提出理顺高校自主办学与政府依法行政关系的对策与建议。Improving the research on autonomy of higher education and governmental administration by law will benefit to promotion of higher education institutions, enhancement of governmental administration, and formation of harmonious atmosphere. Based on the clarification of legal status of the university, the definition of autonomy in higher education, and the essential requirements of administration by law in the context of the autonomy in higher education, this article gives a full theoretical analysis to autonomy in higher education and government＇s administration by law. Meanwhile, this article also renders several approaches to deal with the relationship between autonomy in higher education and government＇s administration by law.
