摘　　要：法学界对公务员双重法律身份划分问题不乏研究,但并没有形成统一的认识。在分析现有原则和标准的基础上,从公务员双重法律身份本身的特征和公务行为与个人行为的划分入手,确立行使行政职权这一反映公务员双重法律身份本质特征的划分标准,并提出具体应用方法。There have been many studies on the partition of the civil servant＇s dual legal identity by law experts, but a unified understanding on this issue has not been formed. Based on an analysis of the existing principles and criterions, starting with the characters of the civil servant＇s dual legal identity and the partition between the official conduct and personal conduct, this paper establishes the administrative power as the criterion for defining the civil servant＇s dual legal identity, and proposes the practical method for the partition of characters of the dual legal identity.
