摘　　要：集体经济组织的演变可以划分为三个历史阶段,即初级合作社时期、高级合作社时期及家庭联产承包责任制时期。从规范层面看,三个阶段的集体经济组织分别存在于现实层面、政策层面及法律层面。通过历史分析,可以清楚地看到在法律层面集体经济组织的真正缺陷所在。另外,从法律文化、改革成本、制度知识等不同角度对集体经济组织缺陷的成因进行深入分析和探讨,有助于我们从制度上完善集体经济组织寻求可靠的理论依据。The evolution of collective economic organizations can be divided into three historical stages： the period of primary cooperatives, senior cooperatives, and household contract responsibility system. From normative perspective, three phases of the respective collective economic organizations exist in reality level, policy level, and legal level. Through historical analysis, we can see clearly on the legal level the real deficiencies of collective economic organizations. Moreover, a thorough analysis of the collective economy organization＇s flaw originated from different areas, such as legal culture, reform cost, and system knowledge, is helpful for us to seek reliable theoretical basis to improve the system of collective economic organizations.
