摘　　要：阐述了运用自由公知技术抗辩的原因及法律依据,提出运用自由公知技术抗辩应具备的条件,指出人民法院理应积极允许并支持自由公知技术抗辩在专利侵权诉讼中运用。This paper expounds the reasons and legal ground of the application of unconfined public technique defense, puts forward the conditions of applying unconfined public technique defense, and points out that the people＇ s court should permit and support actively the application of unconfined public technique defense in the action for infringement of patent.
