论公务员权利救济制度的完善

摘　　要：公务员权利救济制度,是一个国家公务员制度不可或缺的重要方面。由于我国素有重义务轻权利的传统,国家公务员法律体系中对于公务员的权利救济制度存在一定的弊端,比如救济渠道单一、法律制度缺位、救济缺乏公正性和严格的程序、特别权利缺乏法律保障等。只有加强立法保障、确立司法救济、完善行政救济以及强化特别权利保障,才能更好地保障公务员的合法权益免受侵犯。The official rights＇ relief system is an indispensable important aspect in the national official systems. However, our country has the tradition of taking duties seriously and despising rights. In the national official legal framework , the concerned official＇s right safeguard and relief system have the certain malpractice, for instance, the channel is unitary, there are vacancies of legal system,the relief lacks fair and the strict procedure, the special right lacks the legal safeguard and so on. Only by strengthening legislate safeguard, establishing judicature relief, consummating administration relief as well as the strengthened special right safeguard, the legitimate rights and interests of official can be protected effectively.
