摘　　要：开发区行政管理主体的法律定位,是避免开发区行政恣意管理的重要环节。为体现开发区的经济发展的"窗口"功能和"小政府、大市场"的理想体制,开发区管理体制应该定位为:一级人民政府或人民政府的派出机关,享有开发区全面的行政管理职权并承担与一般行政管理主体相区别的行政责任。The legal orientation of development zone administrative management main body is an important move to avoid administrative arbitrariness of development zone. The management system of development zone should have the legal orientation that primary people government or expediting department of people government has the power of development zone and bears the specific d, lty distinguished from general ad- ministrative management main body in order to materialize the function of ＂window＂ of development zone and the idea system of ＂small government and big market＂.
