摘　　要：在阐述物权价值化、物权与债权相区分的基础上,对银行账户资金的属性、存款性质进行分析,得出存款人对银行账户资金即存款享有所有权、存款合同在性质上属于资金保管与转移资金利用权的混合合同的结论。最后论述存款人与银行之间的法律关系等问题。The paper analyzed the nature of the funds in banking account and the depositing funds contract based on the valuation on real fight and the distinguishing between fight of creditor and real right. It concluded that a depositor enjoys a real right over his funds in the banking account and depositing funds contract is a mixed one in nature by a common deposit contract and a contract on transferring the utilization right of the funds. Finally it discussed the relationship between the depositor and the bank.
