摘　　要：中医知识产权还处于初级阶段,大部分尚未进入保护状态。鉴此,应从国家战略的高度,力争通过名医保护、标准规范、商业秘密等一系列战略的实施,改善中医药知识产权保护的环境,加大保护力度。坚持"以保护促发展",不断提高中医药的自主创新能力。只有按照中医药特殊规律建立一套专门的中医药知识产权保护制度,才能够使中医药知识产权得到切实有效的保护,有力地促进中医药事业的可持续发展。Protecting the IP rights of Traditional Chinese medicine （TCM） remains at an early stage, which implies that most of TCM treasures have not been placed under protection. In this context, a national strategy shall be worked out to make the protection. For example, efforts shall be made to protect famous doctors, TCM norms, business secrecy among many others. One should stick to the doctrine of ＂to protect so as to improve the development＂, and keep TCM innovations on the track. TCM based IP protection can be effective only when it goes along with the development pattern of TCM.
